1. Mortgage Broker Disclosure
Loan Daddy LLC (Company NMLS #2827624) is a mortgage brokerage. We are not a lender, bank, credit union, or depository institution. We do not make loans, fund loans, approve loans, or make credit decisions.
As your mortgage broker, we act as an intermediary between you and one or more third-party wholesale lenders. Our role is to help you identify potential financing options, gather your information, and submit your application to lenders in our network. The lender makes all underwriting, approval, pricing, and funding decisions. You are not obligated to use our services, accept any loan offer, or complete a transaction merely because you have submitted an inquiry or received a preliminary scenario review through our platform.
2. Business-Purpose Loan Disclosure
All loans referenced on this Site are business-purpose loans on non-owner-occupied investment real estate. These are not consumer-purpose residential mortgages. By submitting information on this Site, you represent that your loan request is for a business purpose (e.g., acquiring, refinancing, or improving an investment property you do not occupy as a primary or secondary residence).
Consumer-purpose mortgage protections under the Truth in Lending Act (TILA), Real Estate Settlement Procedures Act (RESPA), and related regulations generally do not apply to business-purpose loans. You should consult with your own legal, tax, and financial advisors regarding your specific transaction.
3. Compensation and Fees
Loan Daddy LLC may be compensated by the wholesale lender (lender-paid compensation) or by you (borrower-paid compensation) for services rendered in connection with a closed loan. The specific amount, source, and structure of our compensation will be disclosed to you in writing before you commit to a specific loan. Broker compensation is separate from third-party settlement fees (appraisal, title, recording, escrow, etc.), which are paid to the respective service providers.
4. No Guarantee of Approval
A preliminary scenario review, quote, rate, term, LTV, loan amount, or closing timeline provided through this Site or by Loan Daddy LLC is not a loan approval, a commitment to lend, or a rate lock. Final loan terms are determined by the wholesale lender based on full underwriting, property appraisal, title review, borrower verification, and market conditions at the time of approval.
5. Fair Lending / Equal Credit Opportunity Act (ECOA)
Loan Daddy LLC is committed to fair lending. In accordance with the Equal Credit Opportunity Act (ECOA) and its implementing regulation (Regulation B), we do not discriminate against any applicant on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to contract), receipt of income from any public assistance program, or the exercise in good faith of any right under the Consumer Credit Protection Act.
6. Broker, Not a Lender
Loan Daddy LLC is a business-purpose real estate investor loan broker. Loan Daddy LLC arranges commercial/business-purpose loans through authorized wholesale lender partners. Loan Daddy LLC does not make, fund, underwrite, approve, or deny loans. All credit decisions are made by the wholesale lender. California Financing Law Finance Broker license application pending; California loans are arranged only with properly authorized California Financing Law finance lender partners.
7. Credit Inquiry Disclosure
Submitting an inquiry through our website does not authorize a credit pull or result in a hard credit inquiry. We do not access your credit report during the initial inquiry or scenario-review process.
If you proceed with a formal loan application, the lender may request authorization to pull your credit report. This will be disclosed to you before it occurs, and your written consent will be obtained where required by law. A hard credit inquiry by the lender may temporarily affect your credit score. Multiple credit inquiries for the same type of loan within a 14-45 day window (depending on the scoring model) are generally treated as a single inquiry.
8. Fair Credit Reporting Act (FCRA) Notice
Under the Fair Credit Reporting Act (FCRA, 15 U.S.C. § 1681 et seq.), you have specific rights regarding credit reporting:
- Adverse Action Notice: If a lender takes adverse action (denial, less favorable terms) based in whole or in part on information in a consumer report, the lender is required to provide you with written notice that includes the name and contact information of the credit reporting agency, a statement that the agency did not make the decision, and your right to obtain a free copy of your report and dispute inaccurate information.
- Accuracy: You have the right to dispute inaccurate or incomplete information in your credit report directly with the credit reporting agency (Equifax, Experian, or TransUnion).
- Security Freeze: You have the right to place a security freeze on your credit file at no charge to prevent new accounts from being opened in your name.
- Fraud Alert: You have the right to place an initial or extended fraud alert on your credit file if you are a victim of identity theft.
9. AI and Technology Disclosure
We use artificial intelligence and automated tools to assist with customer service, content creation, document review, and administrative tasks. AI-generated content is reviewed and supervised by authorized personnel before being used to make loan decisions or provide specific loan advice. You may interact with AI-assisted systems during calls, texts, or chat on this Site. No final loan decision is made by AI alone; all loan approvals are made by the wholesale lender based on full underwriting and documentation review.
10. TCPA Disclosure
SMS consent is requested through a separate, optional, unchecked checkbox on forms that collect a mobile number. If selected, it applies only to recurring SMS messages from Loan Daddy LLC. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase or of obtaining any service.
Opt-Out: Reply STOP to any text message to opt out of future text messages. Call (480) 485-1229 or email [email protected] to be removed from our call lists. Opting out of marketing communications does not affect transactional messages related to an active loan inquiry.
11. Call Recording Disclosure
Calls with Loan Daddy LLC may be recorded or monitored for training, quality assurance, and compliance purposes. When you contact us or we contact you, you will typically hear a recording disclosure notice at the start of the call. By continuing the call after this notice, you consent to the recording. If you do not consent, please notify the representative and disconnect.
12. E-SIGN Act
Under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act), you consent to receive disclosures, notices, agreements, and other records related to your loan inquiry and any resulting loan transaction in electronic form (email, secure portal, or on this Site) rather than on paper. You may withdraw your consent to receive electronic records by contacting us at [email protected]. Withdrawal of consent may affect your ability to use certain features of our platform. You may request paper copies of any electronic records at any time.
13. Information Security (Safeguards Rule)
In compliance with the FTC Safeguards Rule (16 CFR Part 314) and the Gramm-Leach-Bliley Act, Loan Daddy LLC maintains a written information security program that includes administrative, technical, and physical safeguards designed to protect customer information.
